Immigration Services

L.V.H.S. assists clients in obtaining either permanent resident/immigrant or temporary/non-immigrant visas that enable them, their alien employees and their families to live and work in Mexico.

Application processes for authorizations and permits for entry of foreigners in Mexico in order to work, invest, study, provide technical assistance, business or travel, under the economic dependency of family members. Mexican Nationality. Permits and authorizations for: Tourists, Transmigrants, Visitors. Permits for shareholders to be able to attend any sort of Partners’, Shareholders’ or Board Meetings, and the disputing of resolutions, etc.

The immigration services rendered by L.V.H.S. have included general counseling on the advantages and disadvantages of the different alternatives available for obtaining visas, assisting in developing documentation to maximize chances of visa approval, and the representation before the National Immigration Institute and the Secretariat of Foreign Relations.

Foreigners in Mexico are entitled to all of the guarantees established in the Constitution, with the restrictions it also contains. As regards immigration and population policy governing the admittance and stay of foreigners in Mexico, the statute to be observed is the General Law on Population (LGP by its initials in Spanish).

Foreigners wishing to enter the country must do so with an administrative authorization which is granted based on the immigration status applied for by the foreigners. They must act honorably at all times and are not to get involved in the country’s political affairs; breaching these terms may be lead to deportation.

The federal government agency in charge of immigration and population policy is the Secretariat of the Interior (SEGOB by its Spanish acronym). It determines the number of foreigners who are permitted entry based on demographic studies, all according to the possibility of their contributing to the country’s progress. In the year 2000, with the Regulations of the LGP, the National Migration Institute was created as a branch organization of SEGOB in charge of regulating the admission and stay of foreigners in Mexico.

Title Search

You will receive a property title search abstract, which is the official document of a title search. This document shows the liens and mortgages found to be recorded according to the title search. When searching for property information it is important to be sure that you receive a title search abstract, not just a property deed. The deed by itself will not contain liens or mortgages. A title representative will review your title document with you personally, in the event that you have any questions.

Some Title Search Details Covered:

  1. Deed copy - Search includes an official copy of the most recent deed, with county recording stamp and date.
  2. Legal description - Full property legal description, typically in "Schedule A" format.
  3. Mortgage search - Mortgage abstract will list open mortgages with mortgage lender information, amounts of mortgages, and dates. Listed in order of apparent priority (first mortage, second mortgage, etc.)
  4. Equity loan search - Report of equity loans (HELOC's) and credit lines against the property.
  5. Tax payment search - Detail of tax assessor account, with amounts and dates of payments, and delinquent payments due.
  6. Foreclosure search - Report on foreclosure status, listing any lis pendens, notice of default (NOD's), and orders to sell under power.
  7. Bankruptcy search
  8. Civil court records search - Report on civil court records found to be recorded against the land records of the property
  9. Mechanics lien search - Report of liens placed by contractors for non-payment of services or materials at the property.
  10. Judgment lien search - Judgment section for property liens as result of financial judgments
  11. Tax lien search - Title section for tax lien encumbrances
  12. Municipal services lien search - Shows liens against the title for unpaid municipal services such as utilities, water, sewer, trash or school assessments.
  13. Child support lien search - Searches for liens of delinquent child support payments.
  14. Treasury lien search - Liens for unpaid IRS tax payments
  15. County name index search - All owners names are run against the county name index for hits on records recorded for the property.
  16. State tax search - Checks for unpaid sales tax, employment taxes, state licenses, and other state-level delinquencies.

  33. Levy on property
  34. Power of attorney - This will show if the property owner has recorded an authorized party to act on their behalf with regard to property transactions.
  35. Property restrictions
  36. Special assessment - Subdivisions and condo associations place these to cover expenses, often as a result of foreclosures in the development.
  37. Release of lien - It is important to check liens to see if any have subsequently been released.

Title Insurance

Title insurance protects a landowner from indebtedness, easements, encumbrances or restriction that can affect his property. Title insurance also provides our clients indemnification in case of loss, and covers legal defense costs if disputes arise.

As an authorized agent for the Mexican firm Real Estate Title, we provide analysis and legal opinions related to your property located in Mexico. We also confirm the legal standing of title for the acquisition of title insurance with First American Title or Fidelity National Title, the top insurance companies in the US.

Official Translation

In an effort to provide our clients all the counsel they need during their stay in Mexico, we offer translation services in English and Spanish, obtaining the collaboration of experts when necessary.
The difference with a simple translation is that a sworn translation is signed and sealed by an authorized sworn translator and has the same effects as the original document.

Although the original documents can be sent by any means (fax, e-mail), the sworn translation can only be supplied on paper as it has to include the signature and seal of a sworn translator recognized by the Mexican Supreme Court of Justice.
Numerous official bodies in Mexico and abroad require this type of translation (ministries, courts, academic institutions). However, with his or her signature and seal the sworn translator attests to the accuracy of the translation, making sworn translations also essential when the precise content of the original text needs to be known for other purposes.

Land Survey

L.V.H.S. offers through its highly qualified team of associates the Land Survey Service which is a method used to survey and identify land parcels, particularly for titles and deeds of rural, wild or undeveloped land. Its basic units of area are the township and section. It is sometimes referred to as the rectangular survey system, although non rectangular methods such as meandering can also be used. The survey was "the first mathematically designed system and nationally conducted cadastral survey in any modern country" and is "an object of study by public officials of foreign countries as a basis for land reform."

Land Subdivision

L.V.H.S. offers through its highly qualified team of associates the Subdivision service which is the act of dividing land into pieces that are easier to sell or otherwise develop, usually via a of a map drawn to scale, showing the divisions of a piece of land. The former single piece as a whole is then known as a subdivision; if it is used for housing it is typically known as a housing subdivision or housing development, although some developers tend to call these areas communities.

Subdivisions may also be for the purpose of commercial or industrial development, and the results vary from retail spaces with independently owned out parcels to industrial parks.

Appraisal

L.V.H.S. offers through its highly qualified team of associates the Real estate appraisal, property valuation or land valuation which is the practice of developing an opinion of the value of real property, usually its market value. The need for appraisals arises from the heterogeneous nature of property as an investment class: no two properties are identical, and all properties differ from each other in their location - which is the most important determinant of their value. The absence of a market-based pricing mechanism determines the need for an expert appraisal/valuation of real estate/property.

A real estate appraisal is performed by a licensed or certified appraiser (in many countries known as a property valuer or land valuer and in Mexico Perito Valuador If the appraiser's opinion is based on Market Value, then it must also be based on the highest and Best Use of the real property.
